General Farm Workers Visa Sponsorship in Australia

General Farm Workers Visa Sponsorship in Australia is a program that allows farmers and agricultural businesses to sponsor overseas workers to work on their farms. This program plays a crucial role in addressing the labor shortage in the agricultural sector and ensuring the continued growth and productivity of the industry.

This program is essential for the agricultural industry in Australia as it provides a reliable source of labor, especially during peak seasons when there is a high demand for workers. Without the General Farm Workers Visa Sponsorship program, farmers would struggle to find enough workers to meet their needs, which could result in reduced productivity and potential financial losses for the industry. Additionally, this program also allows farmers to benefit from the skills and expertise of overseas workers, contributing to innovation and knowledge exchange within the agricultural sector.

Eligibility Criteria for General Farm Workers Visa Sponsorship:

Age and health requirements:

To be eligible for a General Farm Workers Visa Sponsorship in Australia, applicants must meet certain age and health requirements. The age requirement typically ranges from 18 to 45 years old, ensuring that individuals are physically capable of performing the demanding tasks involved in agricultural work. Additionally, applicants must meet the health criteria set by the Australian government to ensure they are fit to work in the industry and contribute to the productivity of farms.

Educational and skills requirements:

It is not typically necessary for farm worker visa sponsorship in Australia. The focus is primarily on physical ability and health, as the work involves manual labor and long hours in challenging conditions. However, having prior experience or knowledge in agricultural work can be beneficial for applicants and increase their chances of securing a sponsorship.

English language proficiency requirements:

Are not typically required for farm worker visa sponsorship in Australia. However, having basic communication skills in English can be helpful for day-to-day interactions on the farm and ensure a smooth work experience. Additionally, some employers may prefer applicants who have a basic understanding of English to facilitate better communication with supervisors and fellow workers.

Application Process for General Farm Workers Visa Sponsorship:

Gather necessary documents and evidence to support your application, such as a valid passport, proof of relevant work experience or qualifications, and a letter of offer from an approved sponsor. It is also important to provide any additional documentation that showcases your ability to fulfill the specific requirements of the job, such as references or certifications in agricultural practices.

Submit an Expression of Interest (EOI) through SkillSelect, an online system used by the Australian government to manage visa applications. In your EOI, provide detailed information about your skills, experience, and qualifications in farm work, as well as your willingness to work in regional areas of Australia. This will help potential sponsors identify you as a suitable candidate for visa sponsorship.

Wait for an invitation to apply and submit a complete application, including all required documents and supporting evidence. This may include proof of your qualifications, work experience, English language proficiency, and health and character assessments. It is important to ensure that all information provided is accurate and up-to-date to increase your chances of a successful application. Once submitted, the Australian government will assess your application and make a decision on whether to grant you a visa.

Sponsorship Obligations for Employers:

Provide suitable work conditions and wages that meet Australian standards and regulations. Employers must also ensure that they are complying with all relevant employment laws and regulations, such as providing a safe and healthy work environment for their sponsored employees. Failure to meet these obligations can result in penalties and potential cancellation of sponsorship.

Comply with all relevant Australian laws and regulations regarding the employment of sponsored workers, including but not limited to workplace health and safety, anti-discrimination, and fair work practices. Employers must also keep accurate records of their sponsored employees’ hours worked and wages paid, as this information may be requested by immigration authorities during audits or inspections. Failure to comply with these obligations can have serious consequences for both the employer and the sponsored employee, potentially leading to fines, legal action, or even loss of sponsorship privileges.

Support the visa holder and ensure their safety and wellbeing Employers should provide adequate support to visa holders, including assistance with finding suitable accommodation, accessing healthcare services, and understanding their rights and responsibilities in the workplace. It is important for employers to create a safe and inclusive work environment, free from discrimination or harassment, to ensure the visa holder’s overall well-being. Additionally, employers should stay updated on any changes in immigration laws or regulations that may affect their sponsored employees and provide necessary guidance to ensure compliance.

Training and Research (402) Visa

The Occupational Trainee Stream of the 402 visa allows you to sponsor a candidate to work on
your farm, whilst undertaking on-the-job training. The 402 visa can be offered for up to 24
months. The candidate must have relevant work experience (or studies) in 12 of the past 24
months. There is no minimum salary and the candidate may be eligible for a 457 visa in the
future. The application requires a detailed training plan that we draft with you.

Temporary Work (Long Stay) (457) Visa

The 457 visa allows a candidate to work on your farm for up to four years. You must obtain an
approval to sponsor, which will be valid for five years. The candidate must be offered a full time
position with a minimum salary of $53,900 + superannuation. If your farm is required to show
labour market testing, we help with this step. The candidate must be nominated in a shortage
occupation, have the relevant work experience and/or qualifications and pass an English test
(unless exempt).

Trainee visa 407

The training visa (407) allows a farm to sponsor an applicant as a trainee Dairy Cattle Farmer. As with the TSS visa and 187 visas, the farm must apply for sponsorship approval. Approval is granted for five years. The sponsoring farm cannot be a sole trader or an individual.

The nomination involves preparing a structured training program for the applicant.

The applicant must show that s/he has worked or studied full time for 12 months (of the 24 months) as a dairy farmer, prior to lodging the visa. This makes the 407 visa a great option for employees with a limited amount of experience. The applicant must work at least 30 hours per week and must be paid at least the minimum Award rate of pay.

The 407 visa is granted for a specific period, anywhere from six months to two years. The Immigration Case Officer decides the length of the visa based on how much training they deem necessary.

If you would like to know more about options to sponsor your dairy farm. Email us at [email protected] or phone 03 9038 9070. Consultations for UDV members are free of charge and members benefit from a discounted visa management fee.

Regional Sponsored Migration Scheme (187 Direct Entry) Visa

The 187 (Direct Entry) visa gives the candidate and dependents permanent residency. The
position must be approved by the local Regional Certifying Body (RCB). The candidate must be
nominated in a shortage occupation, have relevant work experience and/or qualifications, and
pass an English test (unless exempt). Some candidates may need to undergo a skill assessment.
The position must be full time, offered for at least two years, and paid at the market rate.
